You Can Receive Compensation  Even If You Are Partially to Blame

Mr. Kendall vigorously pushes back against all unfair blame his clients receive for their motorcycle accidents. That being said, there are some cases where a motorcycle rider is at least somewhat at fault. Even if you did partially cause your motorcycle accident, you can receive compensation as long as we prove the defendant is more responsible for the crash than you.

This is possible because Nevada law operates under a principle of modified comparative negligence. This means that the damages available to you can rise or fall depending on how responsible you are found to be for causing the crash. As long as you are not more than 50 percent responsible for the accident, you may be able to collect restitution.

Time Is of the Essence

Nevada has a 2 year statutes of limitations
After a motorcycle accident in Nevada, injured motorcyclists or their families have two years to file a claim. This deadline is the same whether you are suing solely for property damage or for life-changing harm like a brain injury

Punitive Damages

The standard form of compensation in injury cases is known as compensatory damages. Examples include medical bills, lost wages, and property damage. In rare cases, punitive damages can also be awarded to set an example and punish a defendant for especially egregious behavior.

An example of a lawsuit where a personal injury attorney could seek punitive damages is a case where a drunk driver hit a motorcyclist. This situation applies because consuming enough alcohol to become drunk while knowing they are going to drive is very reckless.

Punitive damages can be very significant. In a case such as the one described above, the plaintiff could receive a punitive damages award of up to $300,000 if their compensatory damages were under $100,000. If the amount of compensatory damages awarded is $100,000 or more, punitive damages can reach up to three times that amount.

Our Personal Injury Attorney
Stands Up To Motorcycle Accident Stigmas

Many motorcycle accident victims face unfair stigmas following a crash. They are often portrayed as inherently reckless and deserving of their injuries, even when a motorcycle rider followed all traffic laws. Insurance companies frequently use this stigma to repeatedly and wrongfully try to downplay their own liability.

Mr. Kendall believes that all crash victims deserve legal representation. He is glad to represent motorcycle accident victims because they are so often treated unfairly. If you have suffered a motorcycle accident, you need a legal advocate who is truly on your side. Call our Reno, NV, injury law office to speak with a personal injury attorney who will stand by you.
