About Wrongful Death Lawsuits

Lawyer consoling a client

Wrongful death is an area of personal injury law applying to situations in which the injured party passes away. A wrongful death claim can then be made against the at-fault party to hold them responsible. In the state of Nevada, only certain people can file a wrongful death claim:

  • The surviving spouse or children
  • The representative of the deceased person's estate
  • The parents or sibling of the deceased if there is no spouse or children

When our wrongful death lawyer takes your case, he can identify the responsible party or parties and start gathering evidence to prove their liability.

We know that nothing can make up for the loss of your loved one, but our wrongful death attorney can make this time easier for you and your family. William R. Kendall will handle all aspects of your case, so you can focus on grieving and helping your family weather the aftermath of wrongful death.

Common Causes of Wrongful Death

Wrongful death can have many different causes. Among the most common are:

Car Accidents

When motorists fail to pay attention to the road or obey relevant traffic laws, the outcome can be devastating. A driver who texts while driving, drives recklessly, or is intoxicated can cause a catastrophic accident in the blink of an eye. Even if the victim takes care to wear a seatbelt and even if their airbag deploys, injuries can be fatal.

Defective Products

When products are designed, manufactured, and sold, certain safety standards must be followed. If a manufacturer or other entity fails to follow these standards, the fallout can be devastating. Faulty tools, medical devices, and auto parts are often responsible for fatal injuries.

Premises Liability

Property owners have a legal obligation to maintain a safe place for customers, guests, and other people who have a legal right to enter the property. Hazards such as uneven flooring or poorly lit stairs can be easy to ignore, but the truth is that they can easily result in fatal accidents. In these cases, Bill Kendall is ready to stand up for the rights of the bereaved and pursue maximum restitution through a wrongful death claim.

Truck Accidents

Truck accidents are frequently more catastrophic than accidents involving non-commercial vehicles, mainly due to the sheer size and weight of 18-wheelers, dump trucks, and tow trucks. If your loved one has died due to the negligent actions of a truck driver, a truck manufacturer, or a trucking company, our firm is prepared to hold all liable parties responsible for your losses.

If your loved one has lost their life due to any act of negligence, let our wrongful death lawyer help.

To establish liability for a wrongful death, you will need to be able to demonstrate the victim was owed a duty and that duty was breached. For example, a property owner may have failed to resolve a hazard, or a driver may have been texting while driving, compromising their ability to avoid harming other motorists. Each wrongful death case is different, and the approach to the case will vary. When our wrongful death lawyer takes your case, he will examine the facts and find the evidence needed to prove liability and make a claim.

Wrongful Death FAQ

What is the difference between a wrongful death case and a homicide case?

A homicide case is a criminal case, meaning the plaintiff is the government. A wrongful death case is a civil case, which means the plaintiff is an individual. While a criminal case can result in punishments such as jail time for the defendant, a civil case can only result in compensation being paid from the defendant to the plaintiff for their losses. A wrongful death case can be filed against a party who is facing (or has already faced) criminal charges for the same action.

Who can file a wrongful death claim?

In Nevada, a wrongful death claim can be filed either by a personal representative of the deceased person's estate, or the deceased person's surviving family members, such as a spouse, parent, or adult child.

My loved one may have been partially responsible for their own death, but I believe it was mostly the other party's fault. Do I have grounds for a wrongful death claim?

You might. Under the principle of modified comparative negligence, you may be able to collect from a negligent third party in a wrongful death claim if your loved one was no more than 50% responsible for the fatal accident. Here's how it works: If your loved one was determined to be 10% responsible for the accident, the other party was found to be 90% responsible, and the total losses are valued at $1 million, the other party would be liable for $900,000 (90% of those losses).

"Thank you!"
